It is assumed that purchasers will have taken steps to ensure that they
comply with the conditions of registration under the Data Protection Act
and will comply with the mailing preference rules.
The data supplied is for use by the end user or their nominated mailing
house only and cannot be sold on to a third party without the express
agreement of The Publishing Agency Ltd in writing.
Unauthorised use of data by the client, their agents, employees,
subsidiaries or 3rd parties the purchaser has passed the data onto,
whether deliberately of inadvertently, will attract a charge equal to
that of the outright purchase list price for the data and it will be
deemed to be due 14 days after invoice.
Where a multiple use license has been purchased this allows for
unlimited use within a one-year period and the data can be copied into a
computer or reproduced by other means for use in lawful sales and
marketing activities in connection with the licence holder’s business.
It is for use by the purchaser only and may not be sold or let to any
third party for their use. (This excludes fulfilment houses completing
the work for the purchaser)
Unless specifically stated in writing, on The Publishing Agency Ltd order
form as a guarantee, if contact names and telephone or fax numbers are
provided they are not guaranteed as they may change so frequently.
Credit for two new addresses will be given for each genuine “Gone Away”
from mailings if the return is sent to us within six weeks of initial
supply - credits can be used against future mailings or incorporated
into updates.
If “ Gone Aways” returned to us within six weeks of the supply of the
data to you exceed the Direct Marketing Association’s suggested limit of
8% we will refund the cost of labels and discounted postage (to a max
weight of 60gms) for those returns over the 8% limit.. Total damages in
respect of any claim by the client shall, in any event, be limited to
the 50% of the price of the contract.
Credits or refunds will not be given where mail is returned simply
because the addressee did not want the mailing piece. Because
approximately 60% of returned mail checked by telephoning the business
was rejected by them but marked “Gone Away” as a method of trying to
remove the address from the mailing list even though they continue to
trade at the same address. We reserve
the right to check a sample of all such returns and amend the returned
figure and any refund accordingly.
Although care is taken in the collection of the data contained in the
lists and it is checked for accuracy on an on-going basis, The Publishing
Agency Ltd can accept no liability for incorrect information supplied.
Whilst every effort is made by The Publishing Agency Ltd to supply
accurate data, The Publishing Agency Ltd does not guarantee the result of
any mailing or accept liability in the event of failure. |
